In more severe cases, responsible individuals can face criminal charges and prison sentences of up to 10 years. Beyond these legal penalties, companies may also face civil lawsuits from individuals who have suffered harm due to the unlawful use of their personal information. This can include emotional distress, reputational damage, or financial loss.
Importantly, POPIA empowers individuals to take control of their personal information. People have the right to object to their data being used for marketing, to withdraw consent at any time, and to request that their information be deleted or corrected. They can also lodge formal complaints with the Information Regulator, which has the power to investigate and take action against companies that violate the Act. There are also tools and platforms — such as the Direct Marketing Association of South Africa (DMASA) — that allow consumers to register their details on opt-out lists to reduce unsolicited communication.
To protect themselves, South Africans should be cautious about where and how they share their phone numbers.
